The arrest warrant was cancelled by the court on October 27, 2009. The charge of tax evasion was dropped, and that led to his warrant being cancelled, but he apparently still faces the charge of "illegal enterpreneurship" (the top punishment on that charge is below 5 years, house arrest is the usual measure for "less serious" crimes like that and arrest warrants are not issued.)

Alleged murder of his son
On August 22, 2007 Mikhail Gutseriyev's 22-year-old son, Chingiskhan Gutseriyev, died suddenly at home. On this day he had been involved in a minor car accident. Someone from an emergency car gave him a shot, allegedly with a poison. He came home, called relatives to say that he was fine, went to sleep, and died from heart failure. On August 28, 2007 the Tver Court in Moscow issued a warrant for the arrest in absentia of Gutseriyev in response to a petition from the investigative committee of the Ministry of Internal Affairs of the Russian Federation.The arrest warrant was cancelled by the court on October 27, 2009.
