Law regarding same-sex sexual activity

Article 325 prohibits same-sex sexual activity with a maximum penalty of 3 years imprisonment and a fine of up to 1 million Guinean franc

s. This maximum penalty is enforced if one of the offenders are under 21 years of age. Article 326/327 can punish offenders who publicly commit an "act of indecency".

Living conditions

The U.S. Department of State's 2010 Human Rights Report found that "there were deep social, religious, and cultural taboos against homosexual conduct," but "there were no official or NGO reports of discrimination against individuals based on their sexual orientation" and "there were no lesbian, gay, bisexual, or transgender organizations active during the year, but there were no legal impediments to the operation of such groups."
