The only bright spot statewide for the California Republican Party that night were early returns showing Cooley with a lead of up to eight points, in which he and many news organizations declared victory. However, the next morning, returns from Los Angeles County, which was believed to be a Cooley stronghold came in strong for Kamala Harris

, removing one of Cooley's key advantages and making the race too close to call. Cooley then canceled a victory press conference scheduled for that day.

Los Angeles and San Francisco County reported their returns, which favored Harris with less than 38,000 votes (45.9% versus 45.7%) separating both candidates at the end of counting that day.

On November 24, 2010, Cooley conceded the race when it was determined that he was going to be unable to overcome the 50,000+ lead that Harris had built up and maintained during the past week, with a majority of the uncounted ballots coming from counties which Harris won. The closest statewide race of the 2010 cycle in California, Cooley is the top vote-getter of the 2010 Republican ticket, while Harris' victory gave the Democratic Party a clean sweep of all of California's statewide offices - a feat the party last accomplished in 2002

Counting the Votes

In early returns on election night, Cooley held a lead of up to eight points and declared victory. However, the morning after on November 3rd, the race became too close to call http://vote.sos.ca.gov/returns/attorney-general/] when Kamala Harris took the lead in Los Angeles County, which was widely expected to go to native son Cooley, making the race competitive. Cooley then canceled a victory press conference scheduled for that day. Los Angeles and San Francisco County reported their returns, which favored Harris with less than 38,000 votes (45.9% versus 45.7%) separating both candidates at the end of counting that day.

As of November 4, 2010, both campaigns had declared victory, with around 1,000,000 absentee and provisional ballots yet to be counted.
http://www.sos.ca.gov/elections/2010-elections/2010-election-information/november-2010/total-unprocessed-ballots.pdf The Harris campaign stated that uncounted ballots will reinforce their candidate's current lead, while Cooley's campaign stated that uncounted ballots will put their candidate ahead. The unprocessed ballots were roughly split evenly between counties that favor each candidate, with analysts saying that uncounted ballots would be the deciding factor in this race.

As of November 10th, Cooley was leading by 9,555 votes (0.1%). However, on November 16th, Harris was ahead again by 25,379 (0.4%) votes.
The California secretary of State's office said it might be weeks before the winner is determined. Election officials had until Nov. 30 to tally all the votes.
