, had been released in July 2002 after serving a fourteen year prison sentence for aggravated robbery. Schulte was responding to a call concerning a possible burglary

 in the area. When arriving on the scene, Officer Schulte stated that Sherrer was fleeing from the store where the burglary was reported to have occurred. Following a chase and in the midst of a struggle, Schulte's nightstick was taken from him. The suspect proceeded to beat Schulte over the head repeatedly with the weapon. At some point during this struggle, the officer reached for his gun and shot the suspect six times, killing him.

Local community leaders were worried of community fallout, this being the first fatal police shooting of a black male to have occurred since new police protocols were implemented following the 2001 Cincinnati riots

. The Cincinnati Black United Front were critical of the police department's slow handling of the case, not having reported the incident until five hours later. Photographs of Schulte with wounds to the head were made available shortly after the incident.
