In 2003, Kennedy was indicted on several counts of fraud and conspiracy to commit fraud in connection with Richard D. Schultz in helping conceal Schultz's fraudulent ownership interest esimated at $9 million. Kennedy was sentenced to 15 months in prison and a $200,000 fine.
