We are having a ancestral house property in hindustan park kolkata my grand father passed away in the year 1980 without a will leaving his wife two sons and a daughter subsequently my uncle passed away in 1981 and then my grand mother in 1984 and finally my father also passed away in 1992. my aunty who got married in 1953 is right now alive and staying with his two sons from my fathers side my mother and we are Five brothers and five sisters two of my sisters got married and from my uncle side his only son is alive who is born and bought up in England and is currently staying there. we have planned to develop this property in joint venture with a developer now my question is does my aunty has any right to ask for share? if we sell the house outright does my aunty has any right to property and can she file for partition suit? does my unty’s son has any right after my unty’s demise?
