Denial for SEX is a valid ground for DIVORCE!
In this regard, Desertion is one among grounds for Divorce.
Desertion – If one of the spouses voluntarily abandons his/her partner for at least a period of two years, the abandoned spouse can file a divorce case on the ground of desertion.
DELHI HIGH COURT Judgment appearing in various NEWS Papers on 15th October, including in HINDUSTAN published in DELHI.
While taking sex as essential ground for a married life, DELHI HIGH COURT has concluded that if either of wife or husband denies sex for a long duration, it can be taken as valid ground for seeking a divorce.
While pronouncing this judgment, it is immaterial as if the couple is living together or living away from each other.
The bench comprising of Justice Ravinder Bhatt and Nazmi Vaziri dismissed an appeal filed by a wife against the verdict of a Family Court and said that the couple having started living together from 2009 after resolving all the issues between them, facts were clear that despite all this the wife continued denying sex to her husband.
While upholding the judgment of Family Court, the HIGH COURT said that there had been no sex relation between the couple for last 8-9 years because the wife had been living, away from her husband, in GUJRAT, which proves beyond any doubt that there had been no sex relation between them.
The HIGH COURT also ignored false allegations laid by the wife as an act full of cruelty and a valid ground for divorce. The wife had alleged that her husband had illicit relations with her sister-in-law. The wife had married in 1986 and had a son also.
In view of this judgment, the teachings of RSSB, to ban sex after having two kids, amount to forcing its disciples to live a divorced life on the ground of ‘Desertion’ alone being full of cruelty.

Else all RSSB FOLLOWERS/SATSANGIS, who were following such guidelines in married life, could be treated living as divorced/broken married life style.
