A coconut vendor while using his machete cuts off the top of a coconut. the piece falls to the pavement. A woman walking nearby steps on the piece of coconut top which had fallen on the pavement. She slips and stumbles into the path of the vendor, who in swinging his machete cuts her in the neck.

is this Grievous Bodily Harm or is this an Accident? if the former, what points of law must be brought out?
